Well, Tsar Orion has had his Seattle lawyers send threatening letters to http://theblackvault.tv. Those videos will have to be removed, I would hate for the owner to have to deal with any repercussions on my account.

Also today, he has taken down one of my update videos off of Youtube. This is interesting because the video he had taken down had only my voice and images that I own on it, and it constitutes a false DMCA claim on his part, which is illegal.

With The Black Vault uploads being taken down, I decided to put all the Tsarion related videos in one place, on my own website.

I expect some nasty letters from his lawyers tomorrow.

I am very encouraged that my little video has sparked such a strange reaction from him, and I do hope I get a chance to defend the right to free speech sometime. I really do think this is because he has been caught in so many lies in the video. I dont blame him at all.

I thought I would post some info regarding fair use and you can judge for yourself if my video falls under this category.

§ 107. Limitations on exclusive rights: Fair use⁴⁰

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
